June 21, 2018 – Ryan Davis Halberstadt, 26, is charged with first-degree rape or attempted rape, armed criminal action, assault and unlawful use of a weapon.
Halberstadt, of the 200 block of Pierson Street in Excelsior Springs, is charged with attempting to rape an acquaintance with whom he was “obsessed,” according to the alleged victim’s friend, who spoke with a Ray County sheriff’s deputy when the case was reported on May 24.
Halberstadt allegedly ran at the victim and tried to stab her and missed, then put a knife to her throat and also pulled a .40-caliber handgun. He allegedly put the gun under her chin, according to the affidavit of probable cause, and told her to “take your clothes off; I’m going to rape you.” Other people saw the incident and intervened, and Halberstadt took off and was eventually located and arrested.
At the Ray County sheriff’s office, Halberstadt told the deputy that he had argued and “got in her face” with the alleged victim, with whom he said he had a relationship, but that he had not threatened her with either a knife or gun, and had not tried to rape her.
Halberstadt faces one unclassified felony count of first-degree rape or attempted rape, two unclassified felonies of armed criminal action, two felony Es of unlawful use of a weapon, and one felony of second-degree assault. The three unclassified felonies each carry a potential sentence of life imprisonment.
He has pleaded not guilty and remains in Ray County Jail on a $200,000 cash or corporate surety bond. A pre-emptory docket hearing is set for July 10.
